Inbound and Outbound

When you are a foreigner who needs to collect money from a Korean, for whatever reason (e. g. a loan, a price for purchasing your product, a compensation for your damage, etc.) you need a lawyer who understands your side of the story and knows how to apply Korean law for your rights. Same goes when you are a foreigner who encountered a lawsuit from a Korean claiming your money.

Property Inquiry

The problem is, it is practically impossible to collect the debt if the debtor truly does not have any property to pay for it. But what if the debtor has actual property, and they are concealing it to avoid their duties? You need an effective but also not illegal way to investigate their property list. SLG can solve this problem by requesting “Specification of Property” and “Inquiry about Property” to the court.

Seizure and Execution

Even if you won the trial, AND you found the debtor’s property, you still need to turn that property into your money. You can seize it so that the debtor wouldn’t be able to sell it off before you get to it. Then you can liquidate the property by applying for an auction to the court. It would be a long and hard procedure, but SLG would be there every step of the way until you finally get the money.

Use of Criminal Complaint

As well as filing a civil lawsuit, pressing a charge against the debtor with fraud is an efficient way to make them pay back the money. According to Korean case law, if a person borrows money without intention nor ability to pay it back, it could be a fraud. Especially when the debtor refuses to pay you back the money, pressing charge against them would make them much more eager to settle it by proper payment.
