I am sorry to bother you but I have a small question related to applying sentences to concurrent crimes according to art. 38 of korean Criminal Act.

Can someone charged and found guilty with 3 concurrent crimes in 1 trial receive 3 separate prison times sentences? Or will he only receive 1 prison time sentence for the most serious offense with the upper limit raised by half?

It is related to this "Johnny Somali" trial that is going on at the moment in SK and some online sources state that he is facing up to 17 years in prison for 3 crimes ( = consecutive sentencing) but that is not how I understand that art. 38, so I am little bit confused.

Thank you.
